What Is Consent in Email Marketing?

Consent in email marketing is a person's freely given, specific, informed and unambiguous agreement to receive marketing messages, usually recorded as an opt-in with the date, source, IP and the wording they agreed to. Under UK GDPR and the EU regulation consent is one lawful basis for processing; for B2B outreach to work addresses, legitimate interest is often the basis used instead. For consumers and sole traders in the UK, PECR requires prior consent for marketing email, with a narrow exception for existing customers.

How it is measured and used

Consent is evidenced by the record: who, when, how, and to what. Pre-ticked boxes, bundled terms and silence do not qualify. Double opt-in, where the person confirms by clicking a link in an email, produces the strongest record and a verified address at the same time.

Consent is also a data quality signal. A double opt-in list is close to 100% deliverable on the day it is built and decays only with job change. The compliance guide sets out which basis applies to which audience.

Example with numbers

A newsletter grows by 2,000 double opt-in subscribers a quarter. Each record carries the confirmation timestamp and form wording. A complaint to the regulator about one message is closed in a day with the record. The same list, re-verified annually, loses about 8% to job changes, all of which are suppressed before they bounce.
